Summary
Texas is a unique state with a license is required from the Texas Department of Licensing and Regulation (TDLR), not the state insurance department.
In 2021 SCIC, with the support of NHSCA, passed a bill repealing Chapter 1303 of the Texas Occupational Code covering Residential Service Contracts and amending Chapter 1304: Service Contracts to incorporate Home Service Contracts. It also moved the licensing requirement from the Texas Real Estate Commission (TREC) to TDLR. The law carried over the existing regulations promulgated by TREC and remain in effect until TDLR changes them. TDLR is required to promulgate new rules by June 1, 2022.
Note on sales representatives: Although §1304.157(a) of the statute prohibit anyone other than a home service contract provider employee or a licensed real estate agent to sell contracts; the rules pretty much allow anyone to be a sales rep., as long as you provide this disclosure in §1304.157(b).
