Summary
For reasons not clear, the Michigan Insurance Department requested its Attorney General for an opinion in late 2001 as to whether service contracts constituted insurance. SCIC has lobbied the Department of Insurance on a friendly interpretation. NHSCA held a series of discussions and provided information to the Attorney General staff assigned to the project. As of early 2004, the issue remained on the back burner and no opinion was imminent. There was a sense that the Attorney General would consider service contracts as not being insurance if pushed to rule. Legislation providing some limited regulation of home service contracts and a distinction from automobile plans has been considered by the NHSCA but not pursued to date.
