Summary

In 1997, state action to regulate home service contracts was averted due to efforts of NHSCA members and the former National Home Warranty Association (NHWA). A special study committee chaired by Francis X. Pugh on behalf of the Maryland State Department of Labor, Licensing and Regulation concluded that no new legislation was required. However, the committee did issue a letter report dated March 17, 1998 and recommend that the Maryland Association of Realtors (MAR)  place in their statewide residential contract of sales form the following disclosure: NOTICE TO BUYER: IF A WARRANTY PLAN IS BEING OFFERED IN CONNECTION WITH THE PRUCHASE OF THE PROPERTY, IT MAY BE A LIMITED WARRANTY. SINCE SUCH WARRANTY PLANS DO NOT COVER STRUCTURAL DEFECTS AND MAY NOT COVER PRE-EXISITING DEFECTS, YOU SHOULD REQUEST THE REAL ESTATE AGENT TO PROVIDE YOU WITH ANY BROCHURE WHICH DESCRIBES THE PLAN IN ORDER TO DETERMINE THE EXTENT OF COVERAGE PROVIDED BY THE WARRANTY.
