A NAIC model state.
Essentials of the law are same as NAIC; registration with the state, financial assurance, consumer disclosures and limited oversight and enforcement.
Like Washington, New Mexico, Nevada and South Carolina the law exempts all sellers from compliance unless they remain contractually obligated on the contract. This is a major exemption for sellers that take their profits and then turn the contracts over to third parties. Unlike the NAIC, this law requires pre-filing of the contract forms upon registration.
This law became effective July 1, 2000.
